Yun Dong (formally — Yun Dong Education Solutions. doing business as YD — “we”, “us”, “our”) is an educational technology company that provides K-12 school districts with software to improve learning experience by transforming traditional learning materials into cloud based solutions. The privacy of each and every user matters deeply to us, and we strive for transparency in all of our data privacy practices—especially when it comes to identifying the information that we collect, use, share, and disclose, as well as the ways that we help keep your information safe. We take our responsibility to protect your information very seriously. Please remember that we are always here to answer any questions you have, and we look forward to working with you for years to come.

By accessing and using our Website and Products, you are accepting the terms of this Privacy Policy. Additionally, in order to use our Website or use or install any of our Products, you must first read and consent to our Terms of Service. If you do not agree to our Privacy Policy or our Terms of Service, please do not use our Website or our Products.

What does this Privacy Policy cover? This Privacy Policy (“Privacy Policy”) discusses the ways that we collect, use, share, disclose, and protect information collected through our Website and Products (collectively “Services”), which are comprised of:

Please note that because our Privacy Policy covers both the information that is collected through our Website and through our various Products, there will be differences in the ways certain information is collected, used, shared, or disclosed. We encourage you to read our Privacy Policy carefully to understand these distinctions.

What does this Privacy Policy not cover? This Privacy Policy does not apply to organisations or websites of organisations that YD does not own or manage, or to individuals that YD does not employ or manage. For example, there may be links to third party companies available on our Website, support centre, or other Services. Because we do not control or manage these third party companies, we are not responsible for the privacy practices and policies of those companies. We encourage you to check the applicable third party privacy policies and terms of use before submitting any information through those websites.

Which information do we collect and how?

How we collect and store information depends on the particular Services and activities within those Services that you or your school participates in. For example, how we collect and store information depends on whether you visit our Website or if you or your school has decided to use our Products. We collect some information directly from school personnel and other users (e.g., information collected when signing up to use our Products), and we collect some information automatically (e.g., usage and log information when you visit our Website).

Some information that we collect may identify you personally, whereas other information is more generic in nature. We also collect information through our Products that may, alone or in combination with other available information, be reasonably used to identify a current or former student enrolled in a K-12 school or K-12 school district. When we collect such student information for K-12 school purposes, we do it on behalf of a particular school or school district and we refer to this information as “Personal Student Information”. YD collects Personal Student Information only where a school has chosen to use our Products and the school has obtained and/or provided appropriate consent under applicable law, or a relevant legal exception applies to allow us to collect such information.

Information Provided Directly to Us

We may collect the following information directly from our users:

School and School Personnel’s Contact Information: When administrators, teachers, school personnel, or other users submit a request or register for our Products through our Website, we request information necessary to contact the school and to use our Products. For instance, we may ask for a school administrator’s name, email address, phone number, and YD password as well as the school’s name, address, billing address, number of devices, number of students, and network configuration to set up our Products.

School Personnel’s Messages to YD: When school personnel or other users interact with YD through our help centre, community, email, or other means, we may receive and keep the emails, messages, and posts, including any contact information or content of such messages.

Information That We Collect Automatically

As you use our Services, we may automatically collect the following information:

Analytics: Our Services automatically collect data via Google Analytics and other similar services (“our analytics tools”). Our analytics tools may collect information such as your IP address, Internet service provider (ISP), date and time of your visit, browser language, browser type, referring and exit pages and URLs, amount of time spent on particular pages, which parts of our Services you use, which links you click, search terms, operating system, traffic and related statistics, keywords, and/or other general browsing or usage data.

Event Information: We collect information relating to how users interact with our Products and Services, such as service diagnostics and technical logging information (“Event Information”). Some examples of Event Information are which Products you use, how much time you spend using our Products, and how often you use our Products.

Cookies and Local Storage: Our Services utilise Cookies to improve your current and future experience by allowing us to understand your usage of our Services. For example, cookies help our systems recognize you if you return to our Services shortly after exiting them. Cookies are small text files stored on your computer that allow us to personalise the content of our Services. Cookies can be turned off via your browser settings if you so choose. However, if you turn your cookies off, some features of our Services may not function properly. In our Products, we use local storage to help remember your settings and account configuration.

Do Not Track: Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. However, we do not recognize or respond to browser-initiated DNT signals, as the internet industry is still working to determine what DNT means, how to comply with DNT, and how to create a common approach to responding to DNT.

Personal Student Information

A school must register with YD and obtain and/or provide proper consent for us to collect Personal Student Information through our Products. Our Products operate only on school-managed devices and/or accounts. Personal Student Information is collected on behalf of a school via a school’s YD account. Since we operate on behalf of schools, Personal Student Information is the property of and under the control of the school at all times.

Types of Personal Student Information Collected Using Our Products. On behalf of and via a school, YD’s Products collect students’ school-managed account information (e.g., student’s name, email address, Google Profile ID, Google Image URL, and organisational unit). Depending on a school’s selected Products, features, and settings, additional information may be collected such as browsing history, IP address, messages between teachers and students during class time, screenshots, and device identifiers. Personal Student Information may also include geographic location of devices and/or accounts subject to a school’s higher level management (i.e., accounts managed by the school’s Google Admin console), which a school can use for limited school purposes such as when locating and recovering its devices. However, we do not access or store geographic login locations of mobile phones. The Personal Student Information collected may change if a school utilises new features and Products.

Student-Generated Content in Our Products. Our Products typically do not access or store student-generated content. However, if a student has created or stored student-generated content through YD Teacher, the appropriate parent, guardian, or eligible student may submit a request to privacy@ydes.ai to transfer this information to him/her. If this information is still available in our systems and the requestor demonstrates he/she is authorised to have the information, we can provide the student-generated content to the appropriate individual in a commercially reasonable amount of time in either a CSV or other mutually-agreeable format to the appropriate individual. We will take commercially reasonable efforts to fully respond to any request for information, but we cannot guarantee retention of student-generated content.

Submission of Personal Student Information Through Our Website. Our Website is not geared towards individuals under the age of thirteen (13), and is not meant to be used or accessed by individuals under the age of 13. We do not knowingly collect personally identifiable information from children under 13 through our Website without proper consent. If we become aware that a child under 13 has provided us with personally identifiable information without appropriate school or parental consent, we will take steps to verify appropriate consent, obtain appropriate consent, or delete such information.

How do we use the information we collect?

Personal Student Information. We will use Personal Student Information to provide and improve the contracted Products and for legitimate educational purposes for K-12 schools. For example, this information is used to help YD provide better support, improve our Products, and provide our customers with additional information about YD’s Products. We do not sell Personal Student Information. We do not use Personal Student Information to target advertisements or market to students or anyone else, or for any purpose prohibited by the Family Educational and Privacy Rights Act (20 U.S.C. § 1232g; 34 CFR Part 99.3) (“FERPA”), California Business & Professions Code section 22584 (“SOPIPA”), and the California Education Code section 49073.1. We will not use Personal Student Information for any purpose other than those required or specifically permitted by our Privacy Policy, our Products Terms of Service and End User Licence Agreement, or any other agreement between a school and us.

Other Information. We use information other than Personal Student Information for a variety of purposes, including to:

provide you with our Services send you information about your relationship or transactions with us notify you about new features in the Products and new Products and Services provides you with support analyse and improve our Services and to develop new features and Products send you marketing materials about updates to our products features that we believe may be of interest to you notify you of company updates and notable events help prevent fraud and enforce the legal terms that govern your use of our Services administer and troubleshoot our Services.

Aggregate Data: We may create, use, and share aggregate, anonymous, or otherwise de-identified data for various business purposes such as product development, research, and marketing. Such data will not contain any Personal Student Information.

Limited Use Requirements

Our apps use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

When do we share or disclose the information we collect?

We do not sell Personal Student Information or share data except as provided in this Privacy Policy. We may share or disclose information in the following ways:

Third Parties Supporting Our Website and Products: We use other companies to perform certain business-related functions that support or improve our Services. Examples include hosting services, processing payments, sending emails, or customer service tools. When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function, which may include Personal Student Information.

With You or Your School’s Permission: With you or your school’s permission and/or direction, we may share or disclose data, including Personal Student Information, to third parties. For example, if you or your school chooses to integrate YD’s Products with another third party company’s products or services, then we will share your data with your consent and/or direction. With your permission, we may also share or disclose your name, school’s name, and other content through a testimonial video or quotation.

Legal Requirements: We may share or disclose certain data if we believe in good faith that doing so is necessary or appropriate (i) to protect or defend the rights, safety, or property of YD or third parties, including to defend or enforce our Privacy Policy, Terms of Service, End User Licence Agreement, or any other contractual arrangement; (ii) to comply with any law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations; (iii) to respond to claims that content violates the rights of third parties; and/or (iv) with your consent or at your direction.

Business Requirements: We may share or disclose certain data, including Personal Student Information, in connection with or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. In this case, the successor entity is subject to all applicable federal and state laws, including applicable student privacy laws. In connection with such a transaction, we will also work to ensure that the successor entity has a commitment to student privacy.

How do we protect your information?

YD takes the security and privacy of your data very seriously. For these reasons, YD has implemented various technical, administrative, and physical safeguards to protect your information, including specific training of our personnel authorised to access Personal Student Information or other information that can identify you personally. These safeguards vary depending on the sensitivity of the information at issue.

YD is committed to preventing unauthorised access to our systems and data, and will investigate any possible occurrence. In the event of a breach of Personal Student Information, YD will comply with all relevant breach laws, including applicable requirements to provide notification to you, affected parents, legal guardians, and/or eligible students.

When do we delete data?

School’s Request for Deletion of Personal Student Information: At any time during or following the termination of the Agreement, a school may request the deletion of the Personal Student Information held by YD pursuant to this Agreement. YD will take reasonable efforts to delete and/or de-identify such information in a commercially reasonable amount of time under applicable laws, unless we are required to retain such information to comply with our legal obligations or law enforcement, resolve disputes, or enforce our agreements. We will also transfer Personal Student Information at you or your school’s request in a commercially reasonable amount of time in compliance with applicable law.

Deactivated Accounts: We may consider a school’s account to be terminated 365 days after all of a school’s YD licences expire without use, reactivation, or renewal by the school. At that time, we will de-identify and/or delete Personal Student Information within a commercially reasonable period of time as long as that information is not necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

Data Deletion: YD retains the right to delete Personal Student Information or any other school account information in its sole discretion at any time. All Personal Student Information retained will remain subject to our Privacy Policy that was in effect at that time — even after the deactivation of an account or termination of a contract. When fulfilling a deletion request, terminating an account, or otherwise deleting information, YD will endeavour to remove all known Personal Student Information, but we cannot ensure complete destruction of every piece of Personal Student Information.

How can you access and modify information?

Parents, Legal Guardians, and Eligible Students: Upon request and in accordance with applicable law, we may disclose certain Personal Student Information collected through our Products that we and our agents have about you or your child so that you may review and/or request changes in the accuracy of such information. If you wish to request a review or correction of your child’s records, please contact the appropriate official in your school district and ask them to collaborate with the YD team to carry out this action. We will use commercially reasonable efforts to process such requests in a timely manner in accordance with applicable law.

Important Notice to Non-Taiwan Residents

Our Website and Products are operated in the Google Data centre in Taiwan. If you are located outside of Taiwan, please be aware that any information you provide to us will be transferred to and/or accessed within Taiwan. You are consenting to this transfer of information by using our Services or providing any information to us through our Services.

Individuals located outside Taiwan who have questions or concerns regarding YD’s Privacy Policy or practices may direct a complaint in writing to YD’s Privacy Officer: Mike Yung. Within a reasonable time of concluding the investigation, YD’s Privacy Officer will inform the inquiring or complaining individual of the results of the investigation and any steps taken to address the complaint.

Changes to this Privacy Policy

We reserve the right to make changes to this Privacy Policy such as to reflect changes in the law, our data collection and use practices, and the features of our Products. You are responsible for regularly reviewing this Privacy Policy and your YD account for notice of such modifications. Your continued use of YD Services following an update to this Privacy Policy will constitute your acceptance of the updated Privacy Policy. We will notify you of material changes to the Privacy Policy on our Website, and make additional efforts to notify customers of material changes that impact the treatment of data collected through our Products.
